4. Site Access and Readiness
You are responsible for ensuring the site is ready, safe and accessible for the agreed work. This may include arranging access, approvals, traffic management, clear work areas, adequate set-out information and coordination with other trades or contractors.
If a site is not ready, safe or accessible when our team attends, we may need to reschedule the work and reasonable costs may apply.
5. Scheduling, Delays and Weather
We aim to meet agreed timeframes, but scheduling may be affected by weather, site conditions, supplier availability, other trades, safety requirements, access issues or events outside our reasonable control.
Where delays occur, we will work with you to reschedule as soon as reasonably practical.
6. Client Responsibilities
You agree to provide accurate information, review quote details carefully, advise us of any site-specific risks or restrictions, and ensure any required approvals, permits or third-party permissions are in place unless we have expressly agreed to arrange them.
7. Variations
Variations may include changes to quantities, layout, profile, access, timing, materials, site preparation, safety requirements or any work not included in the original scope. Variations may be quoted separately or charged at reasonable rates.
8. Payment
Payment terms will be as stated on the quote, invoice or written agreement. If no payment period is stated, payment is due within the period shown on the invoice.
Late or unpaid invoices may result in postponed work, recovery costs, interest where permitted by law, or other lawful recovery action.
9. Cancellations and Rescheduling
If you need to cancel or reschedule booked work, please notify us as early as possible. Costs may apply where materials, labour, plant, travel or scheduling commitments have already been arranged.
10. Quality, Defects and Rectification
We take pride in delivering commercial-grade kerbing work to a high standard. If you believe there is an issue with our work, please notify us promptly and provide reasonable details so we can assess the matter.
Where rectification is required and is our responsibility, we will work with you to resolve it within a reasonable time.
11. Australian Consumer Law
Under the Australian Consumer Law, businesses must meet basic rights when selling products or services, known as consumer guarantees. These rights cannot be taken away by business terms or statements.
12. Liability
To the maximum extent permitted by law, Kerbs For Carparks is not liable for indirect, consequential or special loss, loss of profit, loss of opportunity or loss arising from delays, site conditions, third-party acts or matters outside our reasonable control.
